General Acceptable Use Policy

This AUP governs the use of Skynyx Host's hosting service. Violation of this AUP may result in suspension or termination of your service. In the event of a dispute between you and Skynyx Host regarding the interpretation of this AUP, Skynyx Host's interpretation, in its reasonable commercial judgment, shall govern.

The following is the entire Acceptable User Policy ("AUP") agreement between Skynyx Host and the personal or corporate account holder. Skynyx Host provides managed web hosting and domain name service. Skynyx Host has certain legal and ethical responsibilities consistent with the use of its servers and equipment involved in these services. Skynyx Host's general policy is to act as a provider of Internet presence. Skynyx Host reserves the right to suspend or cancel a customer's access to any or all services provided by Skynyx Host when we decide that the account has been inappropriately used.

What is Appropriate Usage?

Skynyx Host hosting solutions are designed for small and independently owned businesses and organizations. Our shared hosting service is not intended for enterprise-level needs, for which we recommend VPS, cloud, or dedicated servers.

Shared hosting means multiple customers share the same server environment. To ensure optimal performance, no individual customer's usage may degrade service for others. We monitor our servers 24/7/365 and take necessary actions to protect the server community.

Our hosting service is intended for website hosting only — not for data backups or archiving. Using your hosting account as a storage repository is strictly prohibited.

Offensive Content

You may not publish or transmit via Skynyx Host's service any content that Skynyx Host reasonably believes:

• Constitutes child pornography or pornography
• Is excessively violent or promotes violence/hate speech
• Is unfair or deceptive (e.g., pyramid schemes)
• Is defamatory or violates privacy
• Risks public safety or violates law enforcement operations
• Exposes confidential information or trade secrets
• Infringes copyright, trademark, or intellectual property
• Promotes illegal drugs, gambling, or arms trafficking
• Is otherwise illegal, malicious, or fraudulent

Prohibited materials include: Proxy services, Warez, Escrow, HYIP, MLM, Gaming servers/apps, illegal gambling or lotteries.

Skynyx Host reserves the right to terminate service at its sole discretion and may not issue a refund.

Security

You must take reasonable security precautions, including protecting the confidentiality of your password and changing it periodically.

Bulk Commercial Email

We allow bulk email within limits (max 500 emails/hour/account). Requirements include:

• Recipients must opt-in
• You must verify ownership of recipient email addresses
• No email spoofing or obscured sources
• Compliance with CAN-SPAM Act and applicable laws

This applies to messages sent from or promoting any site hosted on Skynyx Host servers.

Unsolicited Email

You may not send unsolicited emails (bulk or individual) to users who have opted out. All usage must comply with the rules of any accessed networks.

Material Protected by Copyright

You may not copy or distribute any copyrighted work unless:

• You have written permission from the copyright holder
• Your use is permitted under copyright law

Repeat copyright infringers will have their service terminated.

Other Requirements

You must have current and accurate domain registrar information for any domain hosted with Skynyx Host.

Disclaimer

Skynyx Host is under no duty to monitor customer activity. We disclaim responsibility for misuse of our network.

Internet Abuse

Prohibited activities include:

• Unauthorized access to data, systems, or networks
• Monitoring network traffic without authorization
• Denial-of-service (DoS) attacks, mail bombing, or flooding
• Using unauthorized accounts or tricking others into revealing credentials
• Forging TCP/IP headers in email or newsgroup posts
• Activities leading to retaliation against the Skynyx Host network
• Any action that unreasonably interferes with other customers’ use

Newsgroups, Chat Forums, and Other Networks

You must comply with the rules of any forums or networks you use (e.g., IRC, USENET). Posting off-topic commercial content or spamming multiple groups is prohibited.
