1. Overview
This Terms of Service Agreement (the “Agreement”) is between you and Skynyx Host and is effective upon your electronic acceptance.
By using our services, you agree to comply with our Privacy Policy and Acceptable Use Policy, which are incorporated by reference.
2. Eligibility Authority
You must be 18+ or legally able to form binding contracts. If acting on behalf of an entity, you must have the authority to bind that entity.
.uk domains are registered via Nominet. gTLD domains via Wild West Domains, LLC.
3. Accounts
You are responsible for maintaining accurate account information and safeguarding your login credentials.
- Provide and maintain accurate contact details.
- Failure to do so may result in suspension or termination.
- You remain liable for domain use, even if licensed to third parties.
- Domains may be suspended or transferred under certain legal or policy obligations.
4. Rules of Conduct
You agree not to host or share content that is:
- Infringing, illegal, harassing, obscene, or abusive.
- Hateful, misleading, or promotes violence.
- Viruses or malicious software.
- Spam or bulk unsolicited messaging.
Any abuse of support staff or violations may lead to account termination with no refund.
5. Monitoring and Termination
Skynyx Host may monitor and remove content that violates this agreement. Repeat offenders may be banned without prior notice.
6. Reservation of Rights
Skynyx Host reserves the right to suspend, cancel, or modify services at its sole discretion for multiple reasons including abuse prevention, legal compliance, or fraud detection.
7. No Spam Policy
Spamming is strictly prohibited. Maintaining an open SMTP relay is not allowed. No refunds for violations of this policy.
8. Service Level Agreement (SLA)
Skynyx Host guarantees 99% uptime. Service credits may be issued upon request, excluding downtime due to factors outside of Skynyx Host’s control (e.g., DDoS, maintenance, 3rd party failures).
9. Backup and Data Loss
Backups are a courtesy and not guaranteed. You are responsible for maintaining your own data backups.
10. Intellectual Property
You must not violate copyrights or trademarks. Upon DMCA notices, Skynyx Host may remove infringing content with or without notice.
11. Third-Party Links
Skynyx Host is not responsible for content on third-party sites linked from its platform. Use them at your own risk.
12. Disclaimer of Warranties
Services are provided "as is". Skynyx Host disclaims all warranties, express or implied, including fitness for a particular purpose.
13. Limitation of Liability
Skynyx Host is not liable for any indirect or consequential damages. Any claims must be made within one year of the incident. Liability is limited to the amount paid for the affected service.
14. Indemnification
You agree to indemnify and hold Skynyx Host harmless from any claims arising out of your use of the services or violation of this agreement.
15. Force Majeure
Skynyx Host is not liable for delays caused by events beyond its control, including natural disasters, strikes, or government actions.
16. Fees and Payments
Subscriber agrees to pay all applicable fees for Services in effect at the time of registration and/or renewal. It is the Subscriber’s responsibility to keep billing details up-to-date.
Automatic Renewal
As a courtesy, Skynyx Host may automatically renew accounts and domains 15 days prior to expiration at the then-current rate, billed to the payment method on file. Domain renewal obligations remain the responsibility of the Subscriber.
Expired domains may enter Redemption Period after 3 days, during which recovery requires both a Redemption Fee and Renewal Fee.
Cancellation of Automatic Renewal
Subscribers must notify Skynyx Host at least 16 business days before expiration, via email or phone, to cancel automatic renewal with ownership verification.
Nonrefundable Fees
SSL certificates, domain privacy, and domain registrations are strictly nonrefundable.
16.1 Refund and Cancellation Policy
General Refund Guidelines
Refunds are issued to the original payment method within defined time periods. Incidental costs (domain registrations, setup fees, third-party services) are non-refundable.
30-Day Money Back Guarantee
- Refunds are not available for payments via Bank Wire Transfers, Western Union, Checks, or Money Orders.
- No refunds on domains, third-party services, or installations.
- Refunds apply only to first-time accounts (not renewals or second accounts).
- Requests must be within 30 days and justified with a valid technical issue.
- No refunds for monthly plans, suspended/terminated accounts, or illegal content.
Product-Specific Refund Terms
- Shared Hosting: Refundable within 30 days
- VPS Hosting: Refundable within 7 days
- Dedicated Servers: Refundable within 7 days
- Cloud Hosting: Refundable within 7 days
Refund Process
Email help@skynyx.host with account details and refund reason. Processing takes up to 10 business days for approved refunds.
17. No Third-Party Beneficiaries
This Agreement creates no rights or benefits for third parties.
18. Compliance with Local Laws
Users are responsible for ensuring compliance with applicable laws in their jurisdiction.
19. Governing Law
This Agreement is governed by Indian law, with exclusive jurisdiction with courts in Bangalore, India.
21. Domain Renewal
Domain renewal is the client’s responsibility. Issues must be reported within 7 working days by raising a support ticket and emailing.
22. Domain Registration
Clients must ensure accurate details at domain registration (.IN registry requires address, phone, and email). Issues must be reported within 7 working days.

24. Notices and Communication
All legal communication must be in English. Emails and posted notices serve as legal communication.
25. Customer Responsibilities
Customers are responsible for account security, backups, compliance with laws, and malware removal.
26. Pricing Policy
- Skynyx Host reserves the right to change prices or the resources allocated to any plan at any time, with or without prior notice.
- Accounts may receive licenses from third-party service vendors (TPSV). Skynyx Host is not responsible for price changes by TPSV. Any dispute with TPSV is solely between customer and TPSV; Skynyx Host is not liable for such disputes, and customers release Skynyx Host from any related claims or damages.
27. Administrative Access
- Skynyx Host may reset server/website passwords to stay compliant with security audits or data center requirements.
- Customers must ensure a valid email address and server root password are on file to avoid downtime from forced resets.
- Skynyx Host may audit or perform administrative actions, including accessing or modifying your website/server without prior permission in certain critical conditions.
28. Client’s Responsibility for Legal Expenses
- If Skynyx Host is involved in legal proceedings due to a client’s website/email/files/servers, the client must pay or reimburse all related expenses—including lawyer fees, transport, court fees, and business losses.
29. VPN (Virtual Private Network) Prohibition
- The use of Skynyx Host’s servers/services for VPNs is strictly prohibited.
- Violation will result in immediate suspension or termination of accounts/servers without refund if plans are used to create VPNs.
30. Cloud/Backup Storage
- Customers are primarily responsible for backing up data from cloud or backup storage products offered by Skynyx Host.
- No backup guarantee is provided; data recovery is not supported unless a separate backup service is purchased as an add-on.
31. Marketing/Reference
- The customer grants Skynyx Host a limited license to use the customer’s trade name and trademark for referencing the customer’s name in Skynyx Host’s marketing materials and website.
- Skynyx Host may use case studies conducted on behalf or for the customer for marketing or reference purposes.
32. Others
- Your account and data will not be available if you fail to renew the service on time. Data may be automatically deleted if renewal is missed.
- Domain registration is subject to availability at the time of request.
- Skynyx Host is not responsible for failed domain or website transfers from other providers. It is the user’s responsibility to ensure domains are renewed or transferred successfully.
- Dedicated servers are provided on virtualized environments such as VMWare or KVM to ensure quality service and uptime.
- Inode usage limits per plan can be found on the Skynyx Host website. Please refer to your specific plan details.
- All suspended accounts, including reseller accounts and websites, will be terminated. Clients are responsible for taking backups before suspension.
- KYC/Mobile Verification: Skynyx Host may suspend accounts if KYC or mobile verification is pending for over 24 hours. KYC completion is mandatory per Indian government requirements (NIXI & CERT-In guidelines).
- Partner companies are responsible for collecting and retaining customer data for cybersecurity compliance. Regulatory information requests may be directed to relevant partner companies.
33. GSTIN Accuracy & Tax Invoice Policy
- Customers must provide accurate GSTIN information, including company name, address, state, and state code, to ensure correct tax invoices.
- Incorrect GSTIN details may result in GST filing errors and affect eligibility for input tax credit.
- Invoices are processed automatically; manual corrections are not possible after filing. No credit notes are issued after monthly GST filing.
